Immigration Services suspended premium processing services back in March, due to the COVID-19 pandemic. Beginning June 1, 2020 USCIS again began to accept premium processing for all eligible I-140 Immigrant Visa petitions. The government then set forth a timeline for accepting premium processing for certain H-1B and nonimmigrant petitions as follows:

  • June 8, 2020:
    • Cap exempt H-1B petitions filed before June 8, 2020
    • All other Form I-129 petitions (non H-1B petitions) for nonimmigrant classifications eligible for premium processing filed before June 8 (i.e. E-1, H-1B, L-1, O-1, TN)
  • June 15, 2020:
    • Concurrent filings of cap-exempt H-1B petitions requesting premium processing
  • June 22, 2020:
    • All H-1B cap-subject petitions
    • Concurrent premium processing requests for all other Form I-129 petitions for nonimmigrant classifications eligible for premium processing (i.e. E-1, H-1B, L-1, O-1, TN)
