USCIS issued a policy memorandum regarding the procedures and requirements needed to change the gender designation on a USCIS-issued document. This memorandum provides guidance to USCIS employees as they adjudicate petitions and applications that request a modification to the gender designation on critical Immigration documents such as Employment Authorization Documents, Permanent Resident Cards, and Certificates of Naturalization.

In order for USCIS to grant the modification, the individual must provide evidence like a court order granting change of sex or gender; a government-issued document reflecting the requested gender designation, such as a driver’s license or a passport; or a letter from a licensed health care professional certifying the requested gender designation is consistent with the individual’s gender identity. The memo provides a sample of what this certification might look like.

The USCIS-issued documents are limited to indicating only female or male, which means that those are the only two options available for someone wishing to change their gender designation.  Ultimately, this memo allows individuals to modify their legal documents to reflect the gender that they truly identify with, which is a critical step in acknowledging and advancing transgender rights.
